At current you are still able to smelt and mine at the same time.
Start smelting ore and then begin to mine and no check seems to prevent it.

What tool are you using to mine with?

Shovel (everyone pretty much uses a shovel due to the use to price value. Pickaxe is 25gp for 50 uses or Shovel 12gp for 200 uses)

Something got left out in the last update. Fixed for next update.
